Omsk Bank lost a dispute over a license to the Central Bank of the Russian Federation

Moscow Arbitration refused to declare illegal Order No. OD-2519 of 01.11.2019, issued by the Central Bank of Russia, which deprived the license of Omsk Expert Bank JSC. Thus, the court confirmed the legality of the actions of the regulator, which lead to the forced liquidation of the legal entity. Judge Kipel's decision can be appealed within a month to the Ninth Arbitration Court of Appeal, the news agency reports. The basis for issuing the order was the results of inspections of the company's activities in 2019. The company insists that all violations identified during the audit are purely technical and recoverable. In addition, according to the company, in the bank's actions there is no sign of repeated violations necessary to revoke the license, the applicant's position was specified in the case file. The court reminded the plaintiff that over the past year, supervisory response measures have been repeatedly applied to him and the regulator had grounds for revoking the license. At the same time, the judge agreed with the arguments of the representative of the bank that some of the violations were technical and recoverable, however, the systemic nature of the violations identified indicates the neglect of society to comply with the requirements of the current legislation in banking activities. As a result, the legality of the deprivation of a license was confirmed by a court verdict. Recall that by the time the license was revoked, the bank of the Omsk region in terms of assets was in 209th place in the Russian Federation. License Expert Bank lost on November 1, 2019. Among the reasons were the signs of withdrawal of funds, dubious transactions, as well as violations of relevant legislation. The main shareholder of the bank through related legal entities, including those registered outside the country (in Estonia), was the former head of the board Roman Stroikov. At the beginning of May 2020, the bank set debts to 479 creditors in the amount of 6.1 billion rubles. The process of forced liquidation of the JSC is underway.
